On this page you will find the terms of use of the Bredenoord customer portal.

Article 1. Definitions

Portal: Bredenoord’s digital customer platform, which is accessed via https://my.bredenoord.com and allows Users to access their customer environment and the digital services Bredenoord provides.

My Bredenoord Terms and Conditions: these Terms and Conditions that govern the use of the Bredenoord Portal (hereinafter referred to as: ‘Terms and Conditions’)

User: the natural or legal person who has created an Account or otherwise makes use of the Portal.

Account: the personal user environment that allows Users to log into the Portal.

Login details: the combination of user name (e-mail address) and password used to access the Account.

Bredenoord: Bredenoord B.V., established at Zutphensestraat 319, 7317 BM Apeldoorn, registered with the Chamber of Commerce under number 08053082.

Data: digital data that are displayed, entered, exchanged or exported through the Portal, including but not limited to operational or analytical data.

Data Statement: Bredenoord’s document which contains more detailed provisions in relation to the generation, use and sharing of Data, in accordance with the Data Regulation (Regulation (EU) 2023/2854).

Data Regulation: Regulation (EU) 2023/2854 of the European Parliament and the Council dated 13 December 2023 on fair access to and use of Data.


Article 2. Applicability

  1. These Terms and Conditions apply to any use of the Portal and the digital services provided therewith.
  2. By creating an Account or logging into the Portal, the User accepts these Terms and Conditions.
  3. The use of Data via the Portal is also covered by Bredenoord’s Data Statement, which implements the Data Regulation. The Data Statement forms an integral part of these Terms and Conditions.
  4. In the event of any conflict between the Data Statement and these Terms and Conditions, the Data Statement shall apply insofar as it relates to data processing and data sharing.


Article 3. Use of the Portal

  1. The Portal is intended exclusively for business purposes related to the collaboration between the User and Bredenoord.
  2. The User is responsible for all activities that take place through their Account or under their control. Should the User grant access to multiple users or employees, he/she remains fully liable for their actions.
  3. It is prohibited to use the Portal for:
    a. unlawful, fraudulent, discriminatory activities or activities that threaten security;
    b. collecting, copying, exporting or distributing data outside the agreed purposes or in violation of the Data Statement and the Data Regulation;
    c. manipulating data, bypassing safeguards or carrying out reverse engineering;
    d. using automated systems (such as bots or scrapers) to access data or functionalities;
    e. sharing Login details with third parties or providing third parties with access to the Portal other than in accordance with the authorisations granted within the Portal. As a User, you are fully responsible for managing and properly assigning access rights within your organisation and affiliated entities.
  4. Bredenoord may temporarily or permanently block access to the Portal, remove accounts or take action when:
    a. these terms or the Data Statement are violated;
    b. there is (suspected) misuse or data breach; or
    c. this is necessary to protect the security or integrity of the Portal.
  5. Bredenoord reserves the right to claim damages from the User in cases of abuse or violation of these provisions.


Article 4. Login details and security

  1. A separate user account must be created for each natural person that uses the Portal on behalf of the User. Accounts are strictly personal and may not be shared with or transferred to others.
  2. The User is responsible for creating, managing and revoking accounts within their organisation and for the proper assignment of access rights.
  3. For the benefit of security, Bredenoord may take measures to verify that accounts are used properly (such as logging or IP monitoring).
  4. The User shall take appropriate technical and organisational measures to prevent misuse, including the use of strong passwords, two-factor authentication and up-to-date security software.
  5. The User must immediately report loss or suspected misuse of Login details via:

  6. Following notification, Bredenoord may temporarily block the Account or reset the login for the protection of the User.
  7. The User shall ensure that only authorised employees within its organisation are granted access to the Portal and that they are bound by confidentiality with respect to the Data available through the Portal.
  8. Bredenoord is entitled to monitor the use of the Portal to maintain security and compliance with these Terms.


Article 5. Data and rights of use

  1. Any intellectual property rights to the Portal, the underlying software and the data provided by Bredenoord are exclusively vested in Bredenoord or its licensors.
  2. The User retains the rights to the data he/she himself enters or uploads in the Portal.
  3. Data available through the Portal may only be used within the business relationship between the User and Bredenoord and in accordance with Bredenoord’s Data Statement.
  4. Exporting, reusing, reproducing or redistributing Data to third parties is only permitted with Bredenoord’s prior written consent.
  5. Bredenoord makes Data available in accordance with the Data Regulation and does so in a fair, reasonable and non-discriminatory (FRAND) manner.
  6. Bredenoord may modify, expand or discontinue the Portal, including its structure, content or functionalities, at any time without prior notice and without being liable for compensation.


Article 6. Availability and maintenance

  1. Bredenoord strives to ensure proper and continuous availability of the Portal, but does not guarantee uninterrupted or error-free access.
  2. Bredenoord is entitled to temporarily take the Portal out of service for maintenance, modifications, improvements or troubleshooting without prior notice.
  3. Bredenoord is not liable for any loss or damage resulting from the (temporary) unavailability of the Portal, malfunctions, delays or incorrect or incomplete data display.
  4. Bredenoord shall make every effort to minimise interruptions and carry out maintenance outside office hours where possible.


Article 7. Liability

  1. The User is liable for any damages resulting from unauthorised, unlawful or negligent use of the Portal or the Data available through the Portal.
  2. Bredenoord shall only be liable for direct loss resulting directly from an attributable failure to comply with its obligations, up to a maximum of the amount paid by its liability insurance in the case in question.
  3. Bredenoord is not liable for:
    a. consequential loss or damage or loss of profits;
    b. errors or inaccuracies in data entered by third parties or by Users themselves;
    c. misuse, loss or disclosure of data by third parties after they have been lawfully provided to the User.
  4. The User indemnifies Bredenoord against all claims of third parties arising from or related to improper use of the Portal or the Data obtained through the Portal.


Article 8. Privacy and personal data

  1. The processing of personal data through the Portal takes place in accordance with Bredenoord’s Privacy Statement, which is available on Bredenoord’s website.
  2. Insofar as the User enters, stores or exports personal data via the Portal, he/she is responsible for the lawful processing thereof in accordance with the General Data Protection Regulation and other applicable laws and regulations.
  3. Bredenoord acts exclusively as a processor with respect to these personal data, and processes the data only to the extent necessary for the execution of the service to the User and in accordance with the User’s instructions.
  4. Bredenoord will take appropriate technical and organisational measures to secure personal data against loss or unlawful processing.


Article 9. Termination of access

  1. Access to the Portal automatically ends two (2) years after termination of the legal relationship under which the User uses the Portal.
  2. Bredenoord may immediately suspend or terminate access to the Portal when:
    a. there is (suspected) abuse or violation of these Terms and Conditions, the Data Statement or applicable laws and regulations;
    b. the security or integrity of the Portal or the data stored therein is at risk; or
    c. this is required to prevent damage to Bredenoord or third parties.
  3. Upon termination of access, Bredenoord may delete data associated with the Account or anonymise them, subject to legal or contractual retention obligations.


Article 10. Amendments

  1. Bredenoord may amend or supplement these Terms and Conditions at any time.
  2. The most current version of the Terms and Conditions is always available through the Portal.
  3. In case of material changes, Bredenoord will inform the User in advance via the Portal or by e-mail.


Article 11. Applicable law

  1. These Terms and Conditions are governed exclusively by Dutch law.
  2. Any disputes arising from or relating to these Terms and Conditions shall be submitted exclusively to the competent court in Arnhem (District Court of Gelderland).
